Welcome to EINApply ("we," "our," or "us"), a service operated by BLINKPAY LLC, a Wyoming limited liability company. By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
EINApply is a third-party designee service that assists businesses in obtaining Employer Identification Numbers (EINs) from the Internal Revenue Service (IRS).
IMPORTANT: EINApply is not affiliated with or endorsed by the IRS or any other government agency. We are an independent third-party service provider.
2. Services Provided
EINApply provides the following services:
- Collection and organization of information required for EIN applications
- Professional preparation and review of IRS Form SS-4
- Electronic signature facilitation for Form SS-4
- Submission of EIN applications to the IRS as your third-party designee
- Handling of IRS correspondence and follow-up communications
- Processing and delivery of EIN confirmation from the IRS
- Post-EIN support and guidance
- Customer support throughout the application process
Free IRS Alternative:
You can apply for an EIN directly from the IRS at no cost. Our fee is for the professional preparation, review, and submission services we provide as your third-party designee, along with dedicated customer support and expedited processing.
3. Third-Party Designee Authorization
By using our services and electronically signing Form SS-4, you authorize EINApply to act as your third-party designee in all matters related to your EIN application. This authorization allows us to:
- Submit your completed and signed Form SS-4 to the IRS on your behalf
- Discuss your application with IRS representatives if necessary
- Receive your EIN confirmation from the IRS
- Correspond with the IRS regarding your application status
- Handle any follow-up requests or questions from the IRS
Electronic Signature Process: We will prepare your Form SS-4 based on the information you provide and send it to you for electronic signature (e-signature). By electronically signing the form, you certify that all information provided is accurate and complete, and you authorize us to submit the form to the IRS on your behalf.
4. User Responsibilities
You agree to:
- Provide accurate, complete, and truthful information for your EIN application
- Have the legal authority to apply for an EIN on behalf of the entity
- Sign the Form SS-4 within 48 hours of receipt
- Respond promptly (within 48 hours) to any requests for additional information or documentation
- Comply with all applicable federal, state, and local laws
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Use our services only for legitimate business purposes
One Correction Attempt Policy:
If your application is incomplete or contains inaccurate information, we will attempt one (1) correction at no additional charge. Additional correction attempts or resubmissions due to customer-provided inaccurate information may incur additional fees. You are responsible for ensuring the accuracy of all information before submission.
5. Fees and Payment
Our service fees are clearly displayed during the checkout process and vary based on the processing speed you select. We offer multiple processing speed options at different price points:
- Standard Processing Tier: 7 business days
- Express Processing Tier: 2-4 business days
- Rush Processing Tier: Same business day
Important Notes:
- The IRS does not charge a fee to obtain an EIN. Our fee is for the professional preparation, review, and submission services we provide as your third-party designee.
- Pricing is available on our website and is subject to change without prior notice. The price you pay is the price displayed at the time of purchase.
- All payments are processed securely through Stripe. We accept credit cards, debit cards, and other payment methods as displayed at checkout.
- Payment is required before we begin processing your application.
6. Processing Times and Delivery
IMPORTANT: Our processing timelines refer to when WE submit your application to the IRS, NOT when the IRS approves or issues your EIN.
Processing times are estimates for our internal processing and submission to the IRS. They begin once we receive:
- Your completed application with accurate information
- Your signed Form SS-4 (e-signature)
- Full payment
Actual IRS processing and EIN issuance times may vary and are beyond our control. Factors that may affect timing include:
- IRS processing delays and system outages
- Additional information or documentation requirements from the IRS
- Federal holidays and weekends (business days exclude these)
- High volume periods at the IRS (tax season, year-end)
- Incomplete or incorrect information provided by customer
- Customer delays in signing Form SS-4 or responding to requests
We will notify you via email once your EIN has been obtained and provide you with your official IRS confirmation letter.
No Guarantee of IRS Approval:
We guarantee that we will professionally prepare and submit your application to the IRS within the stated timeline. However, we do NOT guarantee that the IRS will approve your application or issue an EIN. IRS approval depends on your eligibility and the accuracy of the information you provide.
7. Refund Policy

Quick Summary:
- Full Refund: Available before we submit your application to the IRS (upon request)
- Partial Refund: Available if we miss our processing deadline due to our error (refund of the price difference between service tiers)
- No Refund: After submission to IRS, after EIN assigned, or for customer-caused delays
8. Limitation of Liability
MAXIMUM LIABILITY CAP:
To the fullest extent permitted by law, BLINKPAY LLC's total liability to you for any claims arising from or related to our services shall not exceed the amount you paid for our services.
NO LIABILITY FOR:
- Delays or failures in processing caused by the IRS or government agencies
- Rejection of EIN applications by the IRS due to ineligibility or incorrect information
- IRS decisions, policies, or changes in regulations
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business opportunities, or goodwill
- Customer-caused delays (not signing documents, not responding to requests)
- Inaccurate or incomplete information provided by customer
- Force majeure events (see Section 20)
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in full.
9. Privacy and Data Protection
We take your privacy seriously. Your personal and business information is protected by:
- 256-bit SSL encryption for all data transmission
- Encrypted database storage with industry-standard security measures
- Limited access to authorized personnel only (need-to-know basis)
- Compliance with applicable data protection regulations (CCPA for California residents)
Data Sharing:

11. Prohibited Activities

- Attempt to gain unauthorized access to our systems, servers, or networks
- Interfere with or disrupt our services or servers

- Resell, redistribute, or commercialize our services without authorization
- Reverse engineer, decompile, or disassemble any part of our services
- Violate any applicable laws, regulations, or third-party rights
- Engage in any conduct that could damage our reputation or business
12. Termination
We reserve the right to refuse service, terminate accounts, suspend access, or cancel orders at our sole discretion, at any time, with or without notice, and without liability, including but not limited to cases of:
- Violation of these Terms and Conditions
- Suspected fraudulent, illegal, or unauthorized activity
- Provision of false, misleading, or inaccurate information
- Abusive, threatening, or harassing behavior toward our staff or representatives
- Non-payment or payment disputes
- Any reason we deem appropriate for the protection of our business
Upon termination, your right to use our services will immediately cease. Termination does not affect any refund rights you may have under our Refund Policy.

We provide administrative assistance for obtaining EINs as a third-party designee service. For legal, tax, or accounting advice, please consult with a qualified attorney, CPA, or tax professional.
"AS IS" AND "AS AVAILABLE":
Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties regarding accuracy, reliability, timeliness, or completeness
- Warranties regarding uninterrupted, secure, or error-free service
- Warranties regarding the results to be obtained from use of our services
NO VERIFICATION OF CUSTOMER INFORMATION:
We do NOT independently verify and are NOT responsible for the accuracy, completeness, or validity of the information you provide. You are solely responsible for ensuring that all information submitted is accurate and truthful.
NO GUARANTEE OF IRS APPROVAL:
We do NOT guarantee that the IRS will approve your EIN application, issue an EIN, or process your application within any specific timeframe. IRS decisions are based on your eligibility and compliance with IRS requirements, which are beyond our control.
14. Changes to Terms
We reserve the right to modify, update, or replace these Terms and Conditions at any time, at our sole discretion, without prior notice. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date.
Your continued use of our services after changes are posted constitutes your acceptance of the modified terms. We encourage you to review these terms periodically.
If you do not agree to the modified terms, you must discontinue use of our services.
15. Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming and the United States of America, without regard to conflict of law provisions.
Any disputes arising under or related to these Terms shall be resolved in accordance with Section 16 (Mandatory Arbitration) below.
16. Mandatory Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Agreement to Arbitrate:
You and BLINKPAY LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services (a "Dispute") will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration Rules:
Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in effect at the time the Dispute arises. The arbitration will take place in Sheridan, Wyoming, or another mutually agreed location. The arbitrator's decision will be final and binding.
Class Action Waiver:
YOU AND BLINKPAY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
You waive any right to participate in a class action lawsuit or class-wide arbitration. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Statute of Limitations:
Any Dispute must be filed within one (1) year after the Dispute arose, or it will be permanently barred.
Opt-Out Right:
You have the right to opt out of this arbitration agreement by sending written notice to support@einapply.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.
Severability:
If the class action waiver is found to be unenforceable, the entire arbitration provision (but not the rest of these Terms) will be null and void. If any other part of this arbitration provision is found to be unenforceable, the remainder will remain in effect.
17. Indemnification
You agree to indemnify, defend, and hold harmless BLINKPAY LLC, its officers, directors, employees, agents, affiliates, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising from or relating to:
- Your use or misuse of our services
- Your violation of these Terms and Conditions
- Your violation of any applicable laws, regulations, or third-party rights
- False, inaccurate, incomplete, or misleading information you provide
- Your lack of eligibility for an EIN or authority to apply
- Any content or information you submit to us
- Any third-party claims arising from your use of our services
- Your breach of any representations or warranties made herein
This indemnification obligation will survive termination of these Terms and your use of our services.
18. User Content and License Grant
Content Ownership:
You retain ownership of any information, data, documents, and content you submit to us ("User Content"). However, by submitting User Content, you grant BLINKPAY LLC a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive, and fully transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content for the following purposes:
- Providing our services (preparing and submitting your EIN application)
- Communicating with the IRS on your behalf
- Maintaining business and legal records
- Improving our services and developing new features
- Creating anonymized, aggregated data for analytics and research
- Complying with legal obligations and responding to legal requests
Representations:
You represent and warrant that you own or have the necessary rights, licenses, and permissions to grant the above license, and that your User Content does not violate any third-party rights or applicable laws.
19. Additional Warranty Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- We make NO warranties regarding the accuracy, reliability, or completeness of information on our website
- We do NOT warrant that our services will be uninterrupted, timely, secure, or error-free
- We do NOT warrant that the results obtained from our services will meet your expectations
- We do NOT warrant that any errors in our services or technology will be corrected
- We do NOT warrant that our website or servers are free from viruses or other harmful components
- We do NOT warrant the accuracy or reliability of any third-party information or services
Any material downloaded or otherwise obtained through our services is at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from such download.
20. Force Majeure
BLINKPAY LLC shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, hurricanes, fires, storms)
- Pandemics, epidemics, or public health emergencies
- War, terrorism, civil unrest, riots, or armed conflict
- Government actions, orders, regulations, or restrictions
- IRS shutdowns, furloughs, or system outages
- Federal holidays and government closures
- Internet service provider failures or network outages
- Power failures or utility outages
- Telecommunications or equipment failures
- Labor disputes, strikes, or work stoppages
- Supplier failures or shortages
- Cyberattacks, hacking, or data breaches beyond our control
In the event of a force majeure situation, we will use reasonable efforts to resume performance as soon as practicable, but our obligations will be suspended for the duration of the force majeure event.
21. Third-Party Links and Services
Our website may contain links to third-party websites, services, or resources that are not owned or controlled by BLINKPAY LLC. We provide these links for your convenience only.
We do NOT:
- Endorse or recommend any third-party websites, products, or services
- Have control over the content, policies, or practices of third-party sites

- Warrant the accuracy, legality, or safety of third-party sites

22. Electronic Signatures and Acceptance
By using our services and clicking "I Agree," "Accept," "Submit," or similar buttons, or by electronically signing Form SS-4, you acknowledge and agree that:
- You have read, understood, and agree to be bound by these Terms and Conditions
- Your electronic acceptance constitutes your legally binding signature
- Electronic signatures have the same legal force and effect as handwritten signatures
- You waive any rights you may have to require a physical signature or non-electronic records
- You consent to conducting business electronically
- You have the authority to enter into this agreement
This agreement is enforceable in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and state equivalents.
23. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it shall be severed from these Terms.
The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms. The remaining provisions shall continue in full force and effect, and shall be construed to give effect to the intent of the parties as reflected in the invalid or unenforceable provision.
24. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, Refund Policy, and Money Back Guarantee, constitute the entire agreement between you and BLINKPAY LLC regarding your use of our services and supersede all prior or contemporaneous agreements, understandings, representations, and communications, whether written or oral.
No Oral Modifications:
These Terms may only be modified in writing as provided in Section 14 (Changes to Terms). No oral modifications or amendments shall be valid or binding.
No Waiver:
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision will be effective only if in writing and signed by an authorized representative of BLINKPAY LLC.
